1. Processing of Personal Data

1.1. Applicable Legal Framework

The processing of personal data by the Company is carried out in strict compliance with the provisions of Law no. 195/2024 on the protection of personal data and other relevant regulatory acts of the Republic of Moldova. The Company guarantees the observance of the fundamental rights of data subjects, ensuring the confidentiality and security of the processed data.

1.2. Purposes of Processing

Your data is collected and processed within the scope of insurance brokerage activity and related services exclusively for the following purposes:

  • (i) Quotation and issuance of insurance contracts: Transmitting requests to partner insurance companies in order to obtain the most advantageous offers and issue the requested insurance policies.
  • (ii) Policy administration, claims assistance, and consulting: Managing the contractual relationship, providing technical assistance and consulting in the event of an insured risk occurrence, and maintaining communication with insurers.
  • (iii) Commercial communications and marketing: Sending notifications, promotional offers, newsletters, or news related to the company's products and services, based on the user's freely given, specific, and prior consent.

1.3. Categories of Data Collected

The categories of data processed may include, depending on the specific insurance service requested:

  • Last name, first name, patronymic, gender, date of birth;
  • Personal code (IDNP / IDNO), citizenship, identity document series and number;
  • Contact details: home/residence address, telephone number, e-mail address;
  • Data specific to insurance activity: driving license, health status data (necessary for life/health or accident insurance), profession, position;
  • Data regarding insured assets (e.g., technical data of motor vehicles, real estate, etc.);
  • Bank details necessary for making payments and signature (where applicable).

1.4. Legal Grounds for Processing

According to Law no. 195/2024, data processing is based on at least one of the following grounds:

  • Performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into an insurance contract;
  • Compliance with a legal obligation incumbent upon the controller;
  • Legitimate interest pursued by the Company in the safe conduct of its brokerage business;
  • Explicit consent granted by the data subject for one or more specific purposes (e.g., marketing communications or processing special categories of data).

1.5. Disclosure and Transfer of Data

Personal data may be transmitted or accessed by third parties only in a legal and secure manner, as necessary, to:

  • Partner insurance and reinsurance companies (from the Republic of Moldova or from the groups they belong to);
  • Competent public authorities, in accordance with legal obligations;
  • Contractual partners and service providers (IT solution and platform maintenance providers, archiving services, courier companies, claim assessment/management service providers, law firms).

  • Secure Online Payments: Online bank transactions made via Visa, MasterCard, or Maestro cards are processed through the solution provided by banking institutions.
  • Note: Bank card data (number, CVV, expiration date) is not stored and is not processed on the servers of B.A.R. Safety-Broker SRL, authorization taking place exclusively in a secure banking environment.

4. User's Obligation Regarding Third-Party Data

If, in order to obtain a quote or conclude an insurance policy, you transmit through our platform the personal data of another person (e.g., a co-insured or a beneficiary), you have the legal responsibility to obtain in advance the express consent of that person for the processing of data for this purpose.

5. Your Rights Under Law No. 195/2024

As a data subject, the new legislation grants you extensive rights to protect your private life. You have the right to:

  • Information and access to your processed data;
  • Rectification of inaccurate or incomplete data;
  • Erasure of data ("right to be forgotten") or restriction of processing, under the conditions provided by law;
  • Objection to data processing (especially for direct marketing purposes);
  • Withdrawal of consent at any time, without affecting the legality of processing carried out on the basis of consent before its withdrawal;
  • Filing a complaint with the National Center for Personal Data Protection (NCPDP) or addressing a court of law if you consider that your rights have been violated.
